What information do we collect?

We collect information from you when you place an order, subscribe to our newsletter, respond to a survey or fill out a form. When ordering or registering on our site, as appropriate, you may be asked to enter your name, e-mail address, address or phone number.

How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway provider’s database only to be accessible by those authorized with special access rights to such systems and they are required to keep the information confidential. After a transaction, your private information will NOT be stored on our servers.

We DO NOT sell, trade, or otherwise transfer to outside parties your personally identifiable information.

What do we use your information for?

Phoenix Garden Solutions may use the information collected from you for several purposes: 

- To tailor your experience – your information aids us in responding more effectively to your unique needs.

TERMS AND CONDITIONS:

Phoenix Garden Solutions will supply, and the customer will purchase the goods and services in accordance with the accepted estimate, subject to these terms and conditions.

 

The final agreed estimate constitutes a written contract for the specified work to be completed at the stated price, with any additional materials to be discussed and included as necessary.

 

Verbal agreements are not binding unless they have been documented in the aforementioned contract.

 

The contract is established between Phoenix Garden Solutions and the individual(s) who have requested our estimate.

 

Phoenix Garden Solutions will not engage in discussions, accept requests, or communicate in any way with anyone other than the client, unless the client has granted permission for such interactions.

 

Accepting the estimate, whether electronically or by other means, indicates full agreement and the commitment to adhere to these terms and conditions.

VALIDITY PERIOD OF ESTIMATE:

Estimates are valid for 2 weeks from issue date.

CHANGES TO YOUR ESTIMATE:

-

Any quotation or estimate may be subject to revision should there be any changes in the scope or nature of the work. This could affect labor and materials due to factors outside Phoenix Garden Solutions' control, such as significant increases in the costs of labour, materials, or other manufacturing expenses. Nonetheless, any amendment to the estimate will not occur without the client's consultation.

THE SERVICES:

-

Commencing from the start date, Phoenix Garden Solutions shall deliver the services as specifically outlined in the accepted estimate.

 

Phoenix Garden Solutions is committed to exercising due care and skill in the execution of the services detailed in the accepted estimate.

SCOPE OF WORKS:

-

The quote written by Phoenix Garden Solutions for the client represents the requests of the client, it is not a builder’s survey and will not be held liable for any task that is not included in the written quote.

​

ADDITIONAL WORK:

-

Any additional work to be carried out for the client will be quoted for separately, and agreed to before being carried out.

​

ELECTRICAL POWER, WATER AND WC FACILITIES :

-

The client will be expected to provide electrical power, running water and toilet facilities where reasonably possible.

​

INSURANCE:

 

Regardless of Phoenix Garden Solutions' insurance policies, it is the customer's responsibility to notify their own insurer that building works will be conducted on their property and to ensure they have sufficient insurance coverage. Phoenix Garden Solutions will not be held responsible for any loss or damage to the works, materials on site, or the customer's property, unless it is due to negligence and this has been explicitly agreed upon.

CANCELLATION:

-

Should the client wish to cancel, they must inform Phoenix Garden Solutions in writing or via email at least two weeks prior to the commencement date.

 

In the event that the client decides to cancel after work has commenced, they agree to compensate Phoenix Garden Solutions for administration, materials restocking, lost work, and scheduling costs, which will be no less than 50% of the total project cost. 

Additionally, the client will be charged for any materials already acquired for the job, which will then be sent via courier at your expense.

MATERIALS:

-

Phoenix Garden Solutions will provide all necessary materials, which will be of high quality and used according to the manufacturer's guidelines, unless otherwise agreed. Any surplus materials remaining on-site upon or after completion will remain the property of Phoenix Garden Solutions.

 

In instances where it is essential to match the existing décor, our work will be executed with this objective, utilizing suitable materials to achieve an exact match whenever possible. Should an exact match be unattainable, we will consult with the client.

 

Phoenix Garden Solutions is not liable for the performance or suitability of any materials, parts, or products that the client purchases directly, and such items will be used by Phoenix Garden Solutions at the client's own risk.

COMPLETION TIME SCALES:

-

Estimated completion times serve as guidelines, and while we strive to finish the work within these timeframes, we cannot be held responsible for any failure to complete the tasks as scheduled due to weather conditions or supplier issues.

​

DAMAGES AND SUB-STANDARD WORKMANSHIP:

-

The client is responsible for clearing objects/items from the work areas. While assistance can be provided for removing bulky objects/items, this may result in additional charges. Should any breakages or damage occur, Phoenix Garden Solutions will promptly inform the client and outline steps to address the issue. If the client is unsatisfied with any aspect of the service upon completion, they must notify us within 24 hours.

 

The client must permit Phoenix Garden Solutions to rectify any issues using our personnel. Phoenix Garden Solutions will not be liable for the costs of repairs carried out by third parties unless we have provided written consent. Any alleged breakages or damage caused by our employees must be reported to us within 24 hours.

PAYMENT TERMS OF QUOTED AND FIXED PRICE WORK:

The client agrees to pay:

-

A 100% deposit of the total material costs, as detailed in the estimate or invoice, is required before the commencement of the project, with the remaining balance payable upon completion.

 

We are willing to issue an invoice, but payment must be made within the time frames specified in our terms and conditions.

 

Deposits should be made via bank transfer unless an alternative arrangement has been made with Phoenix Garden Solutions.

 

Agreeing to a deposit or confirming the start of the project via email or in writing constitutes complete agreement and obligation to adhere to our terms and conditions.

COMPLETION OF PROJECT:

 

The client is required to be available for consultation and final approval on the project's last day. Should the client be unavailable, and no prior arrangement has been made, it will be assumed that the project meets their approval and full payment will be due on that day or within the following 24 hours.

​

LIABILITY:

-

Should rectification of any work be necessary, Phoenix Garden Solutions will make all reasonable effort to complete work as soon as possible and the customer will permit access to fulfil these obligations. Movement, expansion or contraction of sub base or sub base due to (but not limited to), climate changes, tree roots activity underground, drains, mine working, earthquake and changes to the local water table are outside the control of the contractor, therefore we do not cover damage caused by these or relating factors.

These conditions are only applicable to the contracted party and not transferable should the client vacate the address. Phoenix Garden Solutions are not liable for damage or deterioration caused by or resulting from, accidents, misuse, heavy goods vehicles, natural weathering, lack of maintenance, (including repointing after 6 months from date of completion, impact damage, or staining caused by any substance whatsoever, failure to follow the supplier’s instructions whether given orally or in writing.

ASSIGNMENT:

-

The client shall not be entitled to assign the contract or any part of it without the prior written consent of PGS.

TERMINATION OF CONTRACT BY PHOENIX GARDEN SOLUTIONS

-

Phoenix Garden Solutions will not tolerate aggressive or rude behaviour, racism, nationalism, sexism, homophobia or ageism directed towards any of its staff or trades people and reserve the right to terminate the project at any time, in this event, neither Phoenix Garden Solutions nor any of its affiliates or agents shall be liable for any punitive damages arising out of our inability to complete the work specified or by invoking the clause.
